Terms of Service
These terms govern your use of the Ever Peptides website and your purchase of any product from it. Read them before ordering — placing an order means you accept them.
01Agreement to these terms
By accessing this website, creating an account, or placing an order, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, do not use the site or purchase from it. We may refuse service, cancel orders, or close accounts where we believe these terms are being violated.
02Research use only
Every product sold on this site is supplied strictly for in-vitro laboratory research by qualified professionals. Products are not drugs, foods, dietary supplements, or cosmetics. They have not been evaluated or approved by the U.S. Food and Drug Administration, and they are not for human or veterinary use of any kind — no ingestion, injection, topical application, or administration to any person or animal.
By purchasing, you certify that you are acquiring the products solely for lawful research purposes, that you are trained in the safe handling of laboratory materials, and that you will not use, resell, or distribute them for any form of consumption. We reserve the right to request evidence of research intent and to refuse or cancel any order without explanation.
03Eligibility and accounts
You must be at least 21 years of age to use this site or purchase from it. When you create an account or place an order you agree to provide accurate, current information and to keep your account access secure. You are responsible for activity that occurs under your account. We may suspend or terminate accounts at our discretion, including for suspected misuse of products or fraudulent activity.
04Orders, pricing, and payment
All prices are listed in U.S. dollars and may change without notice. An order is an offer to purchase; it is accepted only when we dispatch the products. We may cancel or refuse any order before dispatch — including for suspected non-research use, payment issues, or errors in pricing or stock — and will refund any amount already paid for a cancelled order.
- Promotional codes apply one per order, to the product subtotal only, and may be withdrawn or modified at any time.
- You are responsible for any applicable taxes or duties.
- Payment is processed by third-party payment providers; we do not store full payment card details.
05Shipping and risk of loss
We currently ship within the United States only. Orders placed before the posted same-day cutoff typically dispatch the same business day. Title and risk of loss pass to you when we hand the shipment to the carrier; tracking is provided for every order. Temperature-sensitive materials are offered with cold-chain packaging at checkout — declining it is at your own risk. Inspect shipments on arrival and report damage or shortages within 48 hours.
06Returns and refunds
Because our products are research materials whose integrity depends on handling and storage, we can only accept returns of unopened, unused products in original sealed packaging within 30 days of delivery. Approved returns are refunded to the original payment method, less shipping costs. Products that arrive damaged, defective, or inconsistent with their COA will be replaced or refunded — contact us within 7 days of delivery with your lot number and order number. Opened products cannot be returned.
07Product information and COAs
Certificates of analysis published on this site describe the specific production lot referenced on them and nothing more. Product descriptions, purity figures, and other technical content are provided for research reference only and are not medical, health, or usage advice of any kind. We make reasonable efforts to keep information accurate but do not warrant that the site is error-free.
08Prohibited uses
- Using any product in or on a human or animal, or facilitating anyone else doing so.
- Reselling, relabeling, or distributing products for consumption or as finished goods.
- Purchasing on behalf of a person who could not lawfully purchase directly.
- Misrepresenting your identity, age, or intended use.
- Using the site in violation of any applicable law or regulation.
Violation of this section voids any return or refund eligibility and may result in account termination and refusal of future service.
09Intellectual property
The content of this site — text, graphics, product renders, logos, and layout — belongs to Ever Peptides or its licensors and may not be reproduced or used commercially without written permission, except for ordinary browsing and sharing of links.
10Third-party links and copyright complaints
This site may contain links to third-party websites — for example carrier tracking pages or independent analytical labs. We do not control those sites and are not responsible for their content, policies, or practices; following a link is at your own discretion.
If you believe content on this site infringes a copyright you own, email support@everpeptidelabs.com with (a) identification of the work and of the material claimed to infringe, including where it appears on the site, (b) your name and contact information, (c) a statement of your good-faith belief that the use is unauthorized, (d) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner, and (e) your physical or electronic signature. We review and respond to conforming notices as provided by the Digital Millennium Copyright Act, including removing material where appropriate.
11Disclaimers and limitation of liability
The site and all products are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in section 06. To the maximum extent permitted by law, our total liability for any claim arising from your use of the site or products is limited to the amount you paid for the products giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for any harm arising from use of products contrary to these terms.
12Indemnification
You agree to indemnify and hold harmless Ever Peptides, its owners, and its personnel from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these terms or your use or misuse of any product, including any use inconsistent with section 02.
13Dispute resolution and arbitration
Talk to us first. Before filing any claim, contact us at the address in section 17 with a written description of the dispute. Most issues can be resolved informally; we will try to do so within 30 days.
Binding arbitration. Any dispute arising out of these terms or your use of the site or products that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Nevada or remotely by agreement of the parties. Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or enforce section 02.
CLASS ACTION WAIVER. All disputes shall be arbitrated or litigated on an individual basis only. You and Ever Peptides each waive the right to a trial by jury and the right to participate in a class, collective, consolidated, or representative action.
Opt-out. You may reject this arbitration provision (but not the rest of these terms) by emailing us a written opt-out notice within 30 days of your first purchase.
14Governing law
These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute shall be resolved in the state or federal courts located in Nevada, and you consent to their jurisdiction.
15General provisions
- Severability — if any provision of these terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full effect.
- Entire agreement — these terms, together with the Privacy Policy, are the entire agreement between you and Ever Peptides regarding the site and replace any prior understandings.
- Assignment — we may assign these terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our written consent.
- No waiver — our failure to enforce any provision is not a waiver of the right to enforce it later.
- Force majeure — we are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier disruptions, supplier or laboratory interruptions, utility or network failures, natural events, or governmental action.
16Changes to these terms
We may update these terms from time to time. The "last updated" date above reflects the current version, and continued use of the site after changes take effect constitutes acceptance. Material changes will be posted on this page.
